1.1 CarePlug is an online platform designed to connect patients with licensed healthcare professionals in Zimbabwe, offering a range of telemedicine services. These services include virtual consultations, electronic health records management, appointment scheduling, and secure messaging.
1.2 By using CarePlug, you ("Healthcare Provider" or "you") agree to these Terms and Conditions, which constitute a binding agreement between you and CarePlug. These Terms and Conditions outline the responsibilities and obligations of both parties.
2. Definitions
2.1 "Services" refers to the comprehensive range of telemedicine services provided through the CarePlug platform. This includes:
- Telemedicine consultations with patients
- Electronic health records management
- Appointment scheduling
- Secure messaging
2.2 "Healthcare Provider" means licensed medical professionals registered with relevant Zimbabwean medical authorities (Medical and Dental Practitioners Council of Zimbabwe) and using the CarePlug platform.
3. Healthcare Provider Responsibilities
3.1 Provide Accurate Information
- Provide accurate, complete, and up-to-date professional information, including qualifications, experience, and areas of specialty.
- Ensure that all information provided is truthful and not misleading.
3.2 Compliance with Laws and Regulations
- Comply with applicable Zimbabwean laws, regulations, and guidelines related to healthcare and telemedicine.
- Familiarize yourself with and adhere to relevant professional standards and codes of conduct.
3.3 Maintain Patient Confidentiality
- Maintain patient data confidentiality and adhere to Zimbabwean data protection laws (Data Protection Act) and international best practices.
- Ensure that all patient information is stored securely and protected from unauthorized access.
4. CarePlug Responsibilities
4.1 Platform Maintenance
- Ensure the platform's availability and proper functioning.
- Perform regular updates, maintenance, and backups.
- Notify Healthcare Providers of scheduled downtime.
4.2 Data Security
- Implement robust data security measures to protect patient information.
- Comply with Zimbabwean data protection laws (Data Protection Act).
- Regularly update and maintain data security systems
4.3 Healthcare Provider Verification
- Verify Healthcare Providers' qualifications and registration.
- Ensure Healthcare Providers meet necessary standards.
4.4 Patient Support
- Provide patient support and assistance via the available help channels.
- Address patient concerns and feedback concerning CarePlug platform.
4.5 Payment Processing
- Facilitate payment for Services rendered.
- Ensure timely payment to Healthcare Providers.
4.6 Compliance
- Comply with applicable Zimbabwean laws and regulations.
- Maintain necessary licenses and certifications.
4.7 Communication
- Maintain open communication with Healthcare Providers.
- Notify Healthcare Providers of changes to Terms and Conditions.
4.8 Technical Support
- Provide technical support to Healthcare Providers.
- Address technical issues promptly.
4.9 Dispute Resolution
- Establish a dispute resolution process.
- Address disputes between Healthcare Providers and patients.
5. Clinical Practice Guidelines
5.1 Adhere to Established Guidelines
- Adhere to established clinical practice guidelines and evidence-based medical practices.
- Stay up to date with the latest medical research and developments in your field.
5.2 Ensure Timely Communication
- Ensure timely and responsive communication with patients.
- Respond promptly to patient inquiries and messages.
6. Payment Terms
6.1 Payment for Services
- CarePlug will facilitate payment for Services rendered.
- Healthcare Facilities will receive payment as per agreed-upon rates.
6.2 Payment Schedules
- Payment schedules will be outlined in the Healthcare Facility agreement.
- Payments will be made within 48 hours of service delivery.
7. Confidentiality and Security
7.1 Patient Data Protection
- Maintain patient data confidentiality and adhere to Zimbabwean data protection laws.
- Ensure that all patient information is stored securely and protected from unauthorized access.
7.2 Data Security Measures
- Implement robust data security measures to protect patient information.
- Regularly update and maintain data security systems.
8. Disclaimers and Limitations
8.1 Limitation of Liability
- CarePlug is not liable for damages arising from Healthcare Provider services.
- Healthcare Providers are responsible for their own actions and decisions.
8.2 Independent Contractor Status
- Healthcare Providers are independent contractors, not CarePlug employees.
- Healthcare Providers are responsible for their own professional liability insurance.
9. Termination
9.1 Termination by CarePlug
- CarePlug may terminate or suspend Healthcare Provider accounts for non-compliance with these Terms and Conditions or applicable laws.
9.2 Termination by Healthcare Provider
- Healthcare Providers may terminate their account at any time, provided that any outstanding fees are paid.
10. Governing Law
10.1 Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of Zimbabwe.
10.2 Dispute Resolution
- Any disputes arising from these Terms and Conditions shall be resolved through arbitration in Harare, Zimbabwe, in accordance with the Arbitration Act.
11. Changes to Terms and Conditions
11.1 Updates
- CarePlug reserves the right to update these Terms and Conditions at any time without notice.
11.2 Acceptance
- Continued use of CarePlug constitutes acceptance of updated Terms and Conditions.
Additional Requirements
- Healthcare Providers must:
- Be registered with the Medical and Dental Practitioners Council of Zimbabwe.
- Have valid professional practicing licence.
- Complete CarePlug's onboarding process.
